Understanding pedestrian accidents

Walking to get around is fairly common. In fact, whether it is in a rural, residential or urban area, individuals are seen walking near the roadways or on a sidewalk. Even if it is just in a parking lot, individuals are essentially pedestrians every time they travel. And because these individuals are walking near moving vehicles, there is always a risk for a collision.

Pedestrians are very vulnerable, and it is clear why, as they are traveling by fast moving large vehicles. In fact, even when a vehicle is not fast moving, it can cause severe damage. A person cannot standup to a large metal vehicle, especially since they have no form of protection around them. Because of this, many pedestrian accidents are severe or fatal.

Much like drivers are expected to follow the rules of the road, pedestrians are expected to adhere to the rules as well. Negligence on either side could cause a fatal crash. Motorists are expected to travel at safe speed, slow down at crosswalks and remain attentive. Failure to do so could be the cause of pedestrian accident.

However, a pedestrian may not be exercising care either. In matters where both parties contributed to the crash, it is still possible to seek compensation in a civil action. This could help address the losses suffered, but a monetary award would be reduced to on the percentage the other party was at fault. Those involved in a pedestrian accident should take the time to understand their matter and how best to move forward with a personal injury action.
