I am a personal injury lawyer. I say it proudly. For more than 20 years I have defended the rights of ordinary people against big insurance companies, big corporations, and big government. In many cases, I am the only resource a person has to get justice following a loss. I represent honest people in an honest way, and I make sure that the truth is not twisted to deny my clients fair compensation for their losses.

I occasionally hear criticism of personal injury lawyers. These people claim that because we get paid a percentage of what we recover for our clients, we are motivated to pursue questionable claims. In reality, nothing could be further from the truth. Because we ONLY get paid if we get a recovery for our clients, we are very selective about the cases we accept. We take cases where the truth is more than enough to win, yet the defendant or the insurance company persists in its refusal to offer fair compensation. If we took questionable cases we would go out of business very quickly.

This “contingent fee” arrangement allows the poorest, most disadvantaged people in our communities to seek justice for wrongs committed against them. If we didn’t have contingent fee attorneys, poor people would never be able to afford legal help to fight against the seemingly limitless resources of the rich and powerful. Even so, all claimants, even the poorest, take a risk when they use the legal system. In the United States, unlike in England, each side bears its own costs of litigation. That means if a person sues and loses, they are responsible for the expenses of trial, which can sometimes add up to $100,000 or more.

You may ask why I include government in my discussion. The answer is that we have represented many people in claims against governmental entities, and the government fights these claims as aggressively as the insurance companies. If you are injured because of a road defect, or the negligence of a municipal bus driver, you are entitled to compensation for your loss. But do they pay? Almost never without a fight. Whether we’re talking about your own insurance company or your own government, the moment you ask them for money, you become their adversary and you need someone on your side to even the odds.

In a perfect world, everyone who commits a wrong that harms someone else would simply pay for the damage they have caused. Insurance companies would pay for damage to your car and your medical bills, corporations would pay for the damage to your land caused by their pollution, and governments would pay for the damage resulting from defective roads and sidewalks, and the carelessness of their workers. Sadly, we don’t live in a perfect world – perhaps we never will.

As long as big insurance, big business and big government continue to resist fair and rightful compensation for those injured by their wrongful acts, I will continue to fight on the side of the ordinary people – the people just trying to get their lives back to normal. I go home from work every day feeling good about myself and what I do, knowing that I am on the side of right, of justice, and of fairness.
