Freedom, Responsibility and the Law

As anyone who knows me can tell you, I am an outspoken advocate for liberty. I believe each of us should have the maximum amount of freedom to make decisions regarding how we educate our children, earn a living, obtain healthcare, use our property and spend our free time. Sometimes I am asked how this commitment to freedom is consistent with the work I do as an attorney. The answer is simple. I believe that without a credible, reliable mechanism to hold people and corporations responsible for their actions, meaningful freedom is not possible. Through my firm’s involvement in the civil justice system, we strive to be that mechanism.

It’s really a simple concept, and we learn it as kids: each of us is responsible for our actions and their consequences.

If a child hits a baseball through the neighbor’s window, a responsible parent will make sure that the child acknowledges the harm to the neighbor and pays for the repair or replacement of the broken glass. It doesn’t matter that the child didn’t INTEND to break the glass. What matters is that the child’s decisions and actions directly caused the broken glass, and the child is responsible for the consequences of his actions.

Similarly, when an adult drives carelessly and injures someone else, a doctor uses the wrong instrument or a corporation uses its land in a way that pollutes the surrounding property, they are responsible for the damage they caused, regardless of their intent. In a perfect world, these adults and corporations would acknowledge the harm they caused and offer to pay for the damages suffered by their victims.

Sadly, we do not live in a perfect world. People and corporations in today’s society rarely acknowledge when their actions cause harm to others, and even when they do, there is often disagreement over the measure of damages incurred. That’s where we come in.

We provide access to the justice system for people who have been injured by the actions of other people or businesses. We work closely with our clients to document the events leading to their injuries and the profound impact those injuries have had on their lives. We then take aggressive action to make sure that those who caused the injuries are held fully responsible for the consequences of their actions – no more and no less. In so doing, we maximize the freedom of our clients, whose lives have often been shattered by their injuries.

A vibrant civil justice system with a right to have a jury determine the value of each claim, as guaranteed by the 7th amendment to the Constitution, allows all people to live their lives freely, without undue restrictions on their actions, while making sure injured people can get the recovery they deserve for injuries that were not their fault.

This isn’t a political issue. People of all political backgrounds and in every culture are raised to take responsibility for their actions. We simply help people and corporations do what they already know to be right. We at the Law Offices of Matthew D.
